Terms of Service

Welcome to COALS AI. These Terms of Service ("Terms") govern your use of the AtomC web application (coals.ai), AtomC mobile application, and AtomC desktop application (collectively, the "Services"). COALS AI is a platform operated by Insaan LLC ("we", "our", or "us").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

COALS AI provides an AI-powered assistant service ("AtomC") that can:

  • Engage in conversations and answer questions
  • Assist with coding, writing, analysis, and other tasks
  • Perform web searches to retrieve current information
  • Analyze images you provide
  • Generate images based on your requests
  • Execute commands and file operations (desktop application only)

Our Services are provided on a subscription basis with both free and paid tiers.

3. Mobile and Desktop Application License

3.1 License Grant

The AtomC mobile application (iOS and Android) and desktop application (macOS, Windows, Linux) are licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, nontransferable, revocable license to download, install, and use the applications on devices that you own or control.

3.2 License Restrictions

You may not:

  • Distribute or make the application available over a network where it could be used by multiple devices at the same time
  • Transfer, redistribute, or sublicense the application to any third party
  • Rent, lease, or lend the application to others
  • Copy the application except for reasonable backup purposes

3.3 Reverse Engineering

You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the application, any updates, or any part thereof, except to the extent that such restriction is expressly prohibited by applicable law or to the extent permitted by the licensing terms governing use of any open source components included with the application.

3.4 Device Transfer

If you sell or transfer your device to another person, you must remove the AtomC application from the device before doing so. The license granted to you does not transfer with the device.

3.5 Updates

We may from time to time develop and release updates to the application. Updates may include bug fixes, new features, or security patches. You agree that we may automatically update the application on your device, and you consent to such updates.

4. Account Registration

4.1 Account Creation

To use our Services, you must create an account by providing:

  • A valid email address
  • A secure password, or
  • Authentication through Apple Sign-In or Google Sign-In

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

5. Subscription Plans and Payments

5.1 Plans

We offer the following subscription tiers:

  • Free: Limited usage with basic features
  • Pro: Enhanced usage limits and features
  • Max: Maximum usage limits and all features

5.2 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • Payments are processed through Stripe (web) or your app store (mobile)
  • All fees are non-refundable except as required by law or as explicitly stated

5.3 Credits

  • Additional usage beyond your plan limits may require purchasing credits
  • Credits do not expire while your account is active
  • Unused credits are non-refundable

5.4 Price Changes

We may change our prices with 30 days notice. Continued use after price changes constitutes acceptance of new pricing.

5.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access until then.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use our Services for lawful purposes including:

  • Personal productivity and assistance
  • Professional work tasks
  • Educational purposes
  • Creative projects
  • Software development

6.2 Prohibited Uses

You agree NOT to use our Services to:

Illegal Content & Activities

  • Generate, store, or distribute child sexual abuse material (CSAM)
  • Create content depicting violence against children
  • Plan or facilitate terrorism or violent extremism
  • Engage in fraud, phishing, or identity theft
  • Violate any applicable laws or regulations

Harmful Content

  • Generate malware, viruses, or malicious code intended to harm others
  • Create content that promotes self-harm or suicide
  • Produce non-consensual intimate imagery
  • Generate content that harasses, threatens, or intimidates others

Deceptive Practices

  • Impersonate other individuals or organizations
  • Create deepfakes or misleading media intended to deceive
  • Spread disinformation or manipulate public opinion
  • Misrepresent AI-generated content as human-created where disclosure is required

System Abuse

  • Attempt to bypass usage limits or security measures
  • Reverse engineer, decompile, or extract our AI models
  • Use automated systems to access the Services without permission
  • Interfere with or disrupt the Services or servers

Intellectual Property Violations

  • Infringe on copyrights, trademarks, or other intellectual property rights
  • Generate content that violates third-party rights

6.3 Desktop Application Specific

When using the desktop application's file system and command execution features:

  • You are solely responsible for commands you instruct AtomC to execute
  • Do not use these features to harm your system or others' systems
  • We are not liable for data loss or system damage resulting from your instructions

7. Content Policies

7.1 Your Content

You retain ownership of content you input into our Services ("Your Content"). By using our Services, you grant us a limited license to process Your Content solely to provide the Services to you.

7.2 AI-Generated Content

  • Content generated by AtomC ("Generated Content") is provided for your use
  • You are responsible for reviewing Generated Content before use
  • Generated Content may not be accurate, complete, or suitable for any particular purpose
  • You should not rely on Generated Content for medical, legal, financial, or other professional advice

7.3 Content Monitoring

We may monitor content for:

  • Compliance with these Terms
  • Detection of prohibited content (especially CSAM and violent extremism)
  • Service improvement and safety

7.4 Content Removal

We reserve the right to remove or refuse to process any content that violates these Terms.

8. Intellectual Property

8.1 Our Intellectual Property

The Services, including our software, AI models, design, logos, and documentation, are owned by Insaan LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8.2 Feedback

If you provide feedback, suggestions, or ideas about our Services, you grant us the right to use such feedback without compensation or attribution.

8.3 Third-Party Services and Content

Our Services may access, display, or link to third-party services and content (such as web search results). You acknowledge that:

  • Third-party services are accessed at your sole risk
  • We are not responsible for examining or evaluating the content, accuracy, or availability of third-party services
  • We do not warrant and will not have any liability for third-party materials, services, or websites
  • We may change, suspend, remove, or disable access to third-party services at any time without notice
  • Such content belongs to its respective owners and is subject to their terms

You agree not to use third-party services in any manner that would violate the rights of any other party or that would violate any applicable laws.

8.4 Open Source Components

The applications may contain open source software components. To the extent required by the licenses governing such open source components, the terms of those licenses will apply in place of these Terms with respect to such components. To the extent the terms of such licenses prohibit any of the restrictions in these Terms with respect to such open source component, such restrictions will not apply to that component.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT

We do not warrant that:

  • The Services will be uninterrupted or error-free
  • AI responses will be accurate, complete, or current
  • The Services will meet your specific requirements
  • Any errors will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

10.1 Exclusion of Damages

INSAAN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • System damage or data loss from desktop application use
  • Reliance on AI-generated content
  • Service interruptions or downtime

10.2 Cap on Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • The amount you paid us in the 12 months preceding the claim, or
  • $100 USD

10.3 Exceptions

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Insaan LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you input or generate through the Services

12. Account Suspension and Termination

12.1 Suspension

We may suspend your account immediately if:

  • You violate these Terms, especially the Acceptable Use Policy
  • Your account is used for illegal activities
  • Required by law or legal process
  • Necessary to protect our Services or other users

12.2 Termination by You

You may terminate your account at any time through the account settings or by contacting us.

12.3 Termination by Us

We may terminate your account:

  • For repeated or severe violations of these Terms
  • If required by law
  • If we discontinue the Services (with reasonable notice)

12.4 Effect of Termination

Upon termination:

  • Your right to use the Services ends immediately
  • We may delete your account data (subject to our Privacy Policy)
  • Provisions that should survive termination will remain in effect

13. Modifications to Services and Terms

13.1 Service Changes

We may modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice for material changes.

13.2 Terms Changes

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use after changes constitutes acceptance.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a legal claim, you agree to contact us at legal@coals.ai to attempt informal resolution.

14.2 Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

14.3 Jurisdiction

Any disputes shall be resolved in the state or federal courts located in Sacramento County, California, and you consent to personal jurisdiction in these courts.

14.4 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class arbitration.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Insaan LLC regarding the Services.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.

15.5 No Third-Party Beneficiaries

These Terms do not create rights for any third party.
